Mario,
Just a FYI for you, I was able to not only access the Water Top map but open the portal with enough Rubies before actually killing Maruziel. I was even able to obtain the Dragon Claw from the dragon graveyard.
This was with a Legendary game.

Not really a bug,
the expansion can be entered without defeating Maruziel. However, you can't finish it without killing him first.
